SNOW CLEARING REGULATIONS


Residents of the Town of Conception Bay South and other motorists are hereby informed regarding Snow Clearing Regulations, which are effective immediately. The Regulations are required as part of the Town’s Snow Clearing Program and will be strictly enforced.

1. SNOW CLEARING PERIOD

During the period between the first day in November in each year and the first day in May,  in the year following both days inclusive, and any other period when unusual snow and/or ice conditions prevail, shall be known as the “Snow Clearing Period”.


2. PARKING

In accordance with the Town of Conception Bay South Traffic Regulations, no person shall park a vehicle unattended, regardless of weather conditions, upon a highway within the Town from November 1 in each year and May 1 of the subsequent year. This Regulation is in place to ensure that the Town’s snow clearing operations can be carried out without obstruction.

Residents are hereby notified that Council has authorized its Municipal Enforcement Officers to issue tickets under its Traffic Regulations as of January 1, 2010.

Residents are also reminded that any vehicle, which is ticketed and remains an obstruction to snow clearing operations, may be removed and impounded by the Town and the cost of such removal and impounding shall be recovered from the owner.


3. DEPOSITING OF SNOW

No persons shall deposit or cause or permit to be deposited any snow and/or ice from driveways, sidewalks, parking lots or any other property under their ownership or control onto any street or street reserve within the Municipality.


4. LIABILITY FOR DAMAGES

Claims against the Municipality for damage to mobile or portable articles, garbage boxes, buildings, fences, trees, shrubs, ledges, rock walls and lawns on private property will be accepted by the Municipality when they occur as a result of being struck by equipment operated by employees of the Municipality, or by Contractors during the period of time they are engaged in work on behalf of the Municipality, and where they occur at a distance not less than twenty (20) feet from the center line of the street.



5. DISCLAIM OF DAMAGES

No claims for damages to property will be accepted by the Municipality where:

(a) the damages occurred to property located within twenty (20) feet from the
center line of the street;

(b) the damages occurred as a result of the weight of snow and/or ice deposited on mobile or portable articles, garbage boxes, buildings, fences, trees, shrubs, hedges, rock walls and lawns, or;

(c) lawns become brown or decayed as a result of the deposit of snow and/or ice, or;

(d) a claim for damages is received by the Council after May 31 of the year in which the snow clearing period ends.


6. PENALTIES

(a) Any unattended vehicle parked in contravention of these Regulations within the Municipality may be removed by or on behalf of the Council and impounded, and the total cost of removal and impounding may be recovered from the owner of the vehicle as a civil debt.

(b) Every person who violates or fails to comply with any provisions of these Regulations is guilty of an offence and on Summary conviction is liable to a fine not exceeding one thousand dollars ($1000.00) or, in default, to a period of imprisonment not exceeding ninety (90) days, or to both such fine and period of imprisonment.

(c) The conviction of a person under sub-section (b) does not operate as a bar to further prosecution for the continued failure on the part of a person to comply with these Regulations.


7. PROSECUTION

Prosecution under these Regulations may be taken summarily by an Enforcement Officer, Police Constable or by any person authorized by Council


Information concerning the Town’s Snow Clearing Program may be obtained by calling 834-6528. This service is available to residents 24 hours per day Monday to Friday during the period of the Snow Clearing Program.

The cooperation of residents and vehicle owners/operators will enable the Town forces to carry out its Program in an effective and efficient manner to the benefit of all citizens.
